Electronic Signature Service Terms

These Terms govern the electronic signature service provided through the Sign HUB Platform, owned by HUB DESPACHOS Y PYMES, S.L. (CIF B76816875). By signing a document, the user expressly accepts these Terms.

1. Legal nature of the signature performed

The service applies to each signed document:

Pursuant to Article 25.1 eIDAS, "an electronic signature shall not be denied legal effect and admissibility as evidence in legal proceedings solely on the grounds that it is in an electronic form or that it does not meet the requirements for qualified electronic signatures".

Important clarification

Unless the user expressly uses their own qualified certificate (not included in the standard service), the signature performed does NOT constitute a "qualified electronic signature" of the signer within the meaning of Articles 3.12 and 25.2 eIDAS. The legal equivalence to a handwritten signature provided for in Article 25.2 eIDAS applies only to the qualified electronic signature.

Nevertheless, the set of measures applied (identification of the signer, integrity guaranteed by a qualified seal, time stamping when available, traceability evidence and object-lock retention) gives the signature evidentiary weight before the Spanish courts. Pursuant to Article 326.1 of the Ley de Enjuiciamiento Civil (Spanish Civil Procedure Act), it constitutes full proof as a private document if its authenticity is not challenged. If the counterparty challenges its authenticity (Art. 326.2 LEC), the burden of proving it shifts to the party that submitted it, and the evidence gathered (hash, IP address, OTP, time stamp, traceability certificate) serves as a means of proof whose weight is assessed by the court.

The signed document and its evidence are retained for a minimum of 5 years under an object-lock (WORM) retention policy (WORM system, Object Lock COMPLIANCE), when the storage backend supports it, which prevents their modification or deletion, even by the Owner itself, during that period.

By clicking "Sign document" and ticking the acceptance boxes provided, the signer declares that:

  1. They have read and accept these Electronic Signature Service Terms.
  2. They have read and accept the Privacy Policy and the Cookie Policy.
  3. They give their express and unequivocal consent to sign the document presented to them electronically and to the generation and retention of the associated evidence.
  4. They are aware that this signature has evidentiary weight before the courts pursuant to Reglamento (UE) 910/2014 (eIDAS) and the Ley de Enjuiciamiento Civil (Spanish Civil Procedure Act), amounting to full proof if its authenticity is not challenged (Art. 326.1 LEC).
